This hangs over the hospital leak of Klaas Otto

The online gossip channel ‘Juicechannel_’ published a hospital appointment of Klaas Otto (55), the new sweetheart of Rachel Hazes (52), for a fertility study. This raised the question of whether they might want a child. According to the ‘AD’, the hospital is conducting an internal investigation into the leak. This raises the question of what is hanging over the leaking employee and the hospital.

“We can start an investigation after a complaint from a citizen, or after a report from an organization or after signals from the media”

Furious, seemed Klaas Otto, founder of the controversial motorcycle club No Surrender, on Wednesday. ‘Would these people like to contact me,’ he posted on Instagram, referring to the people behind cheerchannel_. “The scandal is getting juicier,” was the next post from the channel itself. They had spoken to Klaas and the appointment was indeed for him, but turned out to have been made by his ex. Klaas himself does not want any more children, the channel wrote, and did not go to the appointment. ‘Roggel will therefore remain the caring grandmother she already is,’ they concluded the message, referring to Rachel Hazes.

Storm in a glass of water? All’s well that ends well? Certainly not. According to privacy lawyer Marlies van Eck, the systems are logged in the hospital, so it is possible to see whether and by whom a patient file has been looked at. “That’s right for the reconstruction of such an incident,” she says. And not only that. “It also has a preventive effect, so that employees know that it can be seen again.” An organization such as a hospital can periodically check whether medical records are consulted. If the hospital finds out, and there is certainly a chance, this employee, who would have passed on the appointment to the juice channel, risks being fired.

In the Netherlands, the Dutch Data Protection Authority (AP) ensures that privacy is properly monitored by (healthcare) institutions. Hospitals have to organize this properly from an organizational and technical point of view. The AP says they cannot comment on this particular case. But in general, there are many reasons for investigating privacy violations. A spokesperson: “We can start an investigation after a complaint from a citizen, or after a report from an organization or after signals from the media.” If, after that investigation, there is indeed a violation, there are several measures that the AP can take, such as a fine, reprimand, warning in advance, or entering into discussions and making agreements.

In 2018 there was a case around reality star Samantha de Jong, better known as Barbie. Her file was opened dozens of times in 2018 by employees of the Haga Hospital in The Hague. She was admitted there after a suicide attempt. The fine imposed on the Haga Hospital for failing to adequately secure patient files was EUR 350,000. The Haga Hospital itself had issued an official warning to dozens of employees. To prevent privacy violations in the future, the hospital further tightened its procedures. In 2021, the OLVG in Amsterdam was also fined 440,000 euros. A fine is calculated based on factors such as the seriousness of the situation, the duration of the situation, the number of people affected and the nature of the leaked data.

Klaas Otto seems to let the matter rest. He says via Instagram that he does not want to respond. His lawyer Louis de Leon says he is not pursuing legal action against the juice channel. Not even to the hospital. “What’s the point?” Maybe if the juice channel ‘keeps going’. juice channel_ says they shared the post after their source gave permission. The channel says it has had a good conversation with Klaas and is not afraid of legal action. The Jeroen Bosch Hospital has also been asked for a response, but has not yet responded.
